If you book a package holiday, where the organizer is Sustainaway, you are entering into a package travel agreement with Sustainaway BV. In that case, both the ANVR passenger conditions, paragraph 1 and these general terms and conditions Sustainaway BV 2021 apply. A single travel service (eg accommodation or car rental) is not a package holiday. Paragraph 5 applies to these situations.
If a company other than a company mentioned in paragraph 1 is the organizer of the package, you enter into a travel agreement with that organizer. In that case, both the ANVR traveler conditions, paragraph 1 and the (possible) general conditions of that tour operator apply. In the package travel agreement that you conclude with the relevant organizer in this case, Sustainaway BV only acts as a retailer and does not become a party to that package travel agreement.
When you book a trip that meets the criteria of a linked travel arrangement, you enter into separate agreements with the relevant service providers. In that case, the ANVR passenger conditions, paragraph 2 , apply.
The ANVR passenger conditions, paragraph 3 and the (possible) general terms and conditions of the service provider concerned apply to all forms of service provided by Sustainaway BV that do not fall under paragraphs 1 to 3.
Sustainaway BV is not liable for damage caused to or during a trip offered by them through its own actions or that of its partners.
Due to the arrangements that must be reserved at a number of travel destinations, Sustainaway applies cancellation conditions that differ from the travel conditions stated in the ANVR brochure. In the event of cancellation, every traveler owes the following amounts: a) up to 56 days before departure: 15% of the travel sum with a minimum of €250 per person b) from 56 to 28 days before departure: 50% of the travel sum c) in case of cancellation from the 28th day (inclusive) to the 14th day before departure: 75% of the travel sum d) in case of cancellation from the 14th day (inclusive) until the day of departure or later: the full travel sum. You also have to pay 25% of the travel sum. The remainder must be received by us six weeks before departure. It is possible that different cancellation costs have to be charged for your trip.
